The Engineer’s Responses and Determinations
A webinar co-hosted by HKICAdj and Institute of Construction Claims Practitioners (ICCP)
Time & Location
06 Jun 2023, 18:30 – 19:30 GMT+8

About The Event
Many contentions exist on construction projects because the Engineer fails to respond to claims within the contractual time frame, fails to certify amounts legitimately due for claims and when rejecting claims or reducing the amount awarded, fails to adequately explain the reasons for doing so. In many cases these actions will escalate to time-consuming and costly disputes for the Employer.
This CPD presentation will explain the actions that the FIDIC contract oblige the Engineer to take when responding to claims, explains good practice when preparing responses and outlines a procedure which is fully in accordance with the contact and, if followed, will ensure that all Engineer’s responses will be accepted by both the Contractor and the Employer.
Andy Hewitt has over 40-years experience in the construction industry, which has been gained in the United Kingdom, Africa and the Middle East. He has held senior positions with contractors, sub-contractors and consultants and has worked on several iconic projects in the Middle East. He is the author of the following books:
· Construction Claims & Responses: Effective Writing and Presentation
· The FIDIC Forms of Contract: Obligations of the Parties
· FIDIC 1999 Notices: A Guide to the Requirements, Content and Composition of Notices Under the Red, Yellow and Silver Books
· FIDIC 2017 Notices: A Guide to the Requirements, Content and Composition of Notices Under the Red, Yellow and Silver Books
Andy’s experience in commercial, contract and project management led him to specialise in contractual issues, claims and dispute management and is managing director of Hewitt Decipher Partnership. Andy also works as an educator and trainer and to this end, he has developed and launched the ‘Claims Class’ training courses, which are offered on an international basis through various media and platforms.
